FORMAL SESSION:

Chairman VanDenBerg called the meeting to order at 7:00 p.m.

2. Motion made by VanderMaas, supported by Brummel, to approve the minutes of the September 19, 2006 meeting.

VARIANCE B:

Are there unique circumstances or conditions that apply to this property?
VANDENBERG – Yes. They have been described.
Does the request of this variance go beyond the possibility of increased financial return for the applicant?
VANDENBERG – Yes.
Has the immediate practical difficulty been caused by anything other than what the applicant has done?
VANDENBEG – Yes. It is a square building going on a triangle shaped lot.
Will granting this variance uphold the spirit of the ordinance, secure public safety, and uphold substantial justice to property owners in the district? In turn, will denying this variance prevent you, the applicant, substantial rights and privileges that others in the same zoning district are able to enjoy?
VANDERMAAS – Yes.
Has the applicant explored all possible alternatives?
JELSEMA – Yes.
A motion was made by Jelsema, supported by Lubbers, to approve the request for an 8’ front yard building setback from the CSX Railway for a 32’ variance from the 40’ requirement per Section 5-14 E. 4.a. of the Zoning Ordinance for the principal building and an accessory building.

Variance C: 2’ spacing for a 6’ variance where an 8’ landscape buffer is required per Section 8-4 B.2.of the Zoning Ordinance.

STRIKWERDA – The variance is required where the parking lot is cut short due to the triangular shape of the lot. Most of the property will more than meet the landscape buffer requirements.
VANDERMAAS – Will the Planning Commission decide the landscape requirements?
STRIKWERDA – The Zoning Board can add landscaping requirements. The Planning Commission will review landscaping through site plan review.
SALL – He would like each apartment to have a garage stall and an extra stall for storage purposes.
VARIANCE C:

Are there unique circumstances or conditions that apply to this property?
JELSEMA – Yes.
VANDENBERG – How many parking spaces will there be?
STRIKWERDA – Eleven.
Does the request of this variance go beyond the possibility of increased financial return for the applicant?
VANDENBERG – Yes. Parking is not a financial return item.
Has the immediate practical difficulty been caused by anything other than what the applicant has done?
VANDERMAAS – Yes. The shape of the lot presents difficulties.
Will granting this variance uphold the spirit of the ordinance, secure public safety, and uphold substantial justice to property owners in the district? In turn, will denying this variance prevent you, the applicant, substantial rights and privileges that others in the same zoning district are able to enjoy?
JELSEMA – Yes.
Has the applicant explored all possible alternatives?
VANDENBERG – Yes. The property is very limited in what can be done.
A motion was made by Jelsema, supported by VanderMaas, to approve the request for 2’ spacing for a 6’ variance where an 8’ landscape buffer is required per Section 8-4 B.2. of the Zoning Ordinance.
